With respect to securities litigation, Martin R. Galbut is recognized by his peers and clients throughout the community, and nationally for his work in the securities law arena.  He has represented a number of brokerage firms over the years including Merrill Lynch, Alex Brown, JP Morgan, Deutsche Bank and others in the defense of customer claims.  In one case, Boston Chicken, Mr. Galbut was local counsel for Merrill Lynch, Alex Brown and Deutsche Bank in a billion dollar claim before the United States District Court for the District of Arizona, working with prominent lawyers from around the country in defense of the claims in that case which included securities law issues, matters pertaining to underwriting of securities and deepening insolvency.

Mr. Galbut has represented brokerage firms in connection with stockbroker departures and he has also represented stockbrokers in connection with their departing from brokerage firms.

For many years, Mr. Galbut represented customers in disputes with brokerage firms for millions of dollars surrounding losses that the customers sustained.  In one arbitration award against a clearing broker and independent agents, he successfully obtained a $4,000,000.00 award.

Mr. Galbut has also represented stockbrokers in connection with their business disputes with stockbrokerage firms.

On the regulatory front, Mr. Galbut has represented numerous clients before the Arizona Securities Division in proceedings brought by the Division.  He has also represented clients in the context of SEC enforcement proceedings including witnesses and potential targets of investigation.

Mr. Galbut has lectured extensively on securities laws, and arbitration and mediation of such cases.

Many of the cases have been brought before the National Association of Securities Dealers now known as FINRA.  Mr. Galbut and other members of the firm are intimately familiar with the procedures and workings of FINRA and have represented both customers and brokerage firms in those proceedings over the decades.

In addition, the firm has been involved in representing defendants in class action litigation involving securities law issues.

Phoenix business lawyers in the firm including Mr. Galbut, Keith Galbut, and Olivier A. Beabeau have been involved in the prosecution of claims by customers in Ponzi scheme cases.  This has involved the prosecution of those claims civilly, in the Maricopa County Superior Court and in United States District Court, as well as monitoring administrative proceedings by the Arizona Securities Division and the Arizona Attorney General's Office where Ponzi scheme perpetrators have been indicted.  There is a wealth of experience at the firm, and the firm welcomes the representation of stockbrokerage firms as well as customers' brokerage firms who have been injured and damaged in their investments.  The firm also would be pleased to represent the stockbrokers in their relationships with stockbrokerage firms as well as brokerage firms handling situations of brokers moving from one firm to another.

In addition, our business firm has represented a stockbroker in connection with insurance claims that involved trade errors and with claims against the firm for such trade errors.  Thus, the firm can assist in the areas of securities fraud, sales of securities by unregistered salesmen, brokers and underwriters, claims under the federal and state securities laws and claims involving investment losses.
